These Terms of Service (“Terms”) constitute a binding agreement between you and Bitesy LLC (“Bitesy,” “we,” “us,” or “our”) and govern your access to and use of the Bitesy mobile application and related services (the “Service”). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. About the Service
Bitesy is a personalized dining companion that helps users discover nearby dishes suited to their tastes and dietary preferences and explore thoughtfully curated meals with Bitesy Curate™. The Service may display menu, venue, dish, and related information associated with participating restaurants. Bitesy is not a restaurant, food preparation service, food delivery provider, or food service operator.
2. Eligibility
You must be at least 18 years of age to create an account or use the Service. By accessing or using the Service, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.
3. Medical disclaimer
Bitesy does not provide medical advice. The Service is provided for informational and discovery purposes only and is not a substitute for professional medical, health, nutrition, or food-safety guidance. You are solely responsible for evaluating menu items, ingredients, venues, and dining decisions. If you have medical, allergy, or nutrition-related concerns, consult an appropriate healthcare professional.
4. User accounts
A user account is required to access features that depend on saved food preferences or account-based personalization, including personalized recommendations, dashboards, notifications, and subscription-related features. Account access is provided through supported third-party sign-in providers, such as Google or Apple. When you sign in, Bitesy may request limited account information from your sign-in provider, such as your email address, first name, last name, and profile picture. You are responsible for maintaining the confidentiality and security of your sign-in credentials with that provider and for all activity that occurs under your account. You may delete your account through the app at any time.
5. Acceptable use
- You may not use the Service for any unlawful, fraudulent, abusive, or harmful purpose.
- You may not impersonate any person or entity or misrepresent your identity or affiliation.
- You may not access, use, or attempt to access or use another user’s account without authorization.
- You may not interfere with, disrupt, damage, or compromise the Service or its security.
- You may not scrape, reverse engineer, decompile, copy, or commercially exploit the Service except as permitted by applicable law.
6. Intellectual property
The Service, including all text, logos, graphics, software, interfaces, designs, and other content and materials made available through the Service, is owned by Bitesy LLC or its licensors and is protected by applicable intellectual property and other laws. Except as expressly permitted by these Terms, no rights are granted to you by implication or otherwise.
7. Menu and ingredient information
Bitesy may make available menu, dish, ingredient, venue, and food preference information to support discovery, filtering, and personalization within the Service.
Such information may be generated, curated, or maintained by Bitesy based on available menu information, culinary references, restaurant inputs, and structured data systems intended to improve consistency and usability across restaurants.
Participating restaurants may review, add, remove, or modify ingredients or other dish information through tools made available to them. Restaurants are responsible for ensuring that their published menus, ingredient lists, and related modifications accurately reflect their current offerings.
Although Bitesy seeks to present menu and ingredient information in a clear and standardized manner, Bitesy does not prepare food and does not control restaurant sourcing, ingredients, preparation methods, kitchen practices, substitutions, or other operational practices.
Restaurants remain solely responsible for the accuracy, completeness, and verification of their menu, dish, and ingredient information, including any changes made to dishes, ingredients, or offerings after initial publication.
8. Privacy
Your use of the Service is subject to our Privacy Policy, which describes how Bitesy collects, uses, stores, protects, and otherwise handles information in connection with the Service. The Privacy Policy is incorporated into these Terms by reference.
9. Termination
We may suspend or terminate your access to the Service at any time if we determine that such action is necessary to protect the Service, comply with legal obligations, prevent misuse, or enforce these Terms. You may stop using the Service or delete your account through the app at any time.
10. Disclaimer of warranties
To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
11. Limitation of liability
To the fullest extent permitted by applicable law, Bitesy LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or inability to access or use, the Service.
12. Indemnification
You agree to indemnify, defend, and hold harmless Bitesy LLC and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any applicable law or third-party right.
13. Changes to the Service or Terms
We may modify, suspend, or discontinue the Service, in whole or in part, at any time. We may also update these Terms from time to time. Any updates will be posted on this page, and the effective date will be revised to reflect the date of the latest update.
